Giveaway Offer Rules:
- Please read these full rules (“Rules”) before participating in the giveaway offer (the “Offer”). By participating in the Offer, you represent that you satisfy all of the eligibility requirements below and agree to be bound by these Rules.
- Eligibility: To receive the Offer, you must be invited by SurveyMonkey Europe UC (“Sponsor”) through email or other electronic means, and you must: (1) attend a short HR discovery conversation (no more than 40 minutes) prior to 23:59 pm GMT on June 30th, 2021, as mutually scheduled by you and Sponsor; (2) be employed in a Human Resources (“HR”) or HR-related job title; (3) be a resident of the European Economic Area, the United Kingdom or Switzerland (collectively, the “Territory”) with a mailing address in the Territory; (4) be employed at a European Company that is not currently using SurveyMonkey SME; (5) demonstrate at least one use case of how your European Company needs an online employee feedback solution; and (6) be over 18 years of age. A “European Company” means a corporate entity formed under the laws of any member state of the Territory with a physical mailing address in the Territory and including subsidiaries of international companies, provided they have an office located in the Territory. Participation in the Offer is by invite-only. To be eligible, invitations must be received directly from Sponsor, and may not be transferred, duplicated, or otherwise disseminated. Participation in the Offer is limited to one (1) invited individual per European Company. Employees, representatives and agents of Sponsor, its affiliated companies, and each of their immediate family members are not eligible.
- Limitations and Participant Verification: The Offer is valid only while Reward supplies last. Qualifications determined by SurveyMonkey and may be based on your company’s current HR needs. In the event of multiple HR discovery conversations provided to eligible employees from the same European Company, only the first qualifying HR discovery conversation from such European Company will be eligible.
If it is discovered by Sponsor that you have attempted to: (i) obtain more than one (1) Reward per European Company; (ii) participate without an invitation; (iii) transfer or otherwise copy or disseminate invitations; and/or (iv) use any means not in keeping with Sponsor’s interpretation of the letter and/or spirit of these Rules to participate in or to disrupt this Offer; then you may be disqualified from the Offer in Sponsor’s discretion. Sponsor reserves the right to require proof of identity and/or eligibility for the purposes of verifying an individual’s eligibility to participate in this Offer.
- Offer Period: The Offer begins at 9:00 AM GMT February 1st, 2021 and ends at 23:59 PM GMT on June 30th, 2021 (the “Offer Period”). You must have scheduled and attended your entire HR discovery conversation prior to the end of this Offer Period.
- Rewards and ARV: Eligible participants will receive one (1) €50 e-voucher for a select online food delivery service (as determined by Sponsor, and based on region), with an approximate retail value of €50 (each a “Reward”). Use of vouchers / gift cards is subject to all applicable terms, conditions, and policies of the issuer.
No substitution, cash redemption or transfer of Rewards is permitted except at Sponsor’s discretion. If the advertised Reward cannot be awarded for any reason, we reserve the right to substitute a reward of equal or greater value.
Participants are solely responsible for any and all taxes pertaining to the Rewards.
- Reward Redemption: In order to receive the Reward, you must provide your email address as the Reward will be delivered electronically within 30 days days after you attend the HR discovery conversation.
If an eligible Reward recipient: (a) cannot accept (or is unwilling to accept) the applicable Reward for any reason; and/or (b) is determined by Sponsor to be in violation of these Rules, then he/she will be disqualified and will forfeit all rights to the Reward. By accepting a Reward, you confirm your eligibility to receive the Reward in compliance with applicable law and or policy, and further release the Released Parties from any and all liability in connection with this Offer.
- Responsibilities and Liability:
7.1 You are responsible for providing Sponsor with accurate and up to date contact information.
7.2 Sponsor is only liable for damages caused intentionally or by negligence.
7.3 Sponsor shall not be held liable for technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; the unavailability or inaccessibility of any transmissions or telephone or Internet service; unauthorized human intervention in any part of the entry process or the Offer; electronic or human error which may occur in the administration of the Offer or the processing of entries; any delay in the performance or non-performance of an obligation which would be due to an epidemic and/or a force majeure event.
7.4 In other cases Sponsor is only liable - unless otherwise provided for in clause 7.5 - in case of breach of a contractual obligation, the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which you may regularly rely (so-called cardinal obligations), limited to the compensation of foreseeable and typical damage. In all other cases our liability is excluded subject to the provisions of clause 7.4.
7.5 Sponsors liability for damages resulting from injury to life, body or health and according to the Product Liability Act as well as for fraudulently concealed defects remains unaffected by the above limitations and exclusions of liability.
7.6 The above limitation of liability also applies to Sponsor's legal representatives and vicarious agents.
- Data Protection:
The controller for your personal data in connection with this offer is SurveyMonkey Europe UC, an Irish company located at 2 Shelbourne Buildings, Second Floor, Shelbourne Rd., Dublin 4, Ireland (“Sponsor”). If you have any questions regarding data protection, you can contact us here.
The Sponsor processes the personal data collected for the participation of this Offer exclusively for the purpose of carrying out the Offer and therefore for the performance of a contract. The processing of your e-mail-address in order to send you an invitation for a HR discovery conversation is based on your consent, which you may withdraw at any time for the future by contacting us here. Your personal data will be stored for the duration of the Offer and, in the event of an invitation for a HR discovery conversation and your attendance in such, for the purpose of processing the HR discovery conversation and for the Reward redemption.
In connection with your participation in the Offer you inter alia have the data protection rights to access, rectification, deletion, restriction of processing, portability as well.
- Miscellaneous: The decisions of Sponsor with respect to this Offer are final and binding, including decisions regarding the eligibility of participants. Sponsor reserves the right to cancel, modify, extend or suspend the Offer at any time for any reason. Sponsor and each of its respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) are not responsible or liable for any lost, stolen, late, incomplete, illegible, interrupted, or misdirected participations, mail or e-mail, or Offer-related materials or if any participant’s contact information does not work or is changed without participant giving prior written notice to Sponsor. Sponsor has the right to disqualify any individual who attempts to participate fraudulently or deceptively, or otherwise not in accordance with Sponsor’s interpretation of these Rules.
This Offer is governed by the laws of Ireland.
